A site inspection was made of the Ross Pit as part of the Division's 4-year inspection <br />program. Present during the inspection was Joe Bauer of Bauer Brothers Construction, the <br />lessee. <br />2. The Ross Pit is permitted for a total of 9.52 acres. Dewatering and dry mining activities <br />are used in an old oxbow of the Yampa River to excavate a 20 foot thick gravel deposit. The <br />operator has posted a financial warranty of $5,000 in the form of a Certificate of Deposit. <br />The reclamation plan specifies creation of a private fishing lake with 3:1 shoreline slopes <br />to 10 feet below the water line and 2:1 slopes to the bottom of the lake. <br />3. The operator has committed to maintaining a 100-foot buffer between the pit and the active <br />riverbank. The operator has a15o specified that contemporaneous reclamation will be employed <br />as much as practical to limit the disturbance at any one time. <br />4. The current disturbance consists of a partially reclaimed 3/4-acre lake and 3-4 acres of <br />plant, processing, and stockpile area. Minor grading will be required to complete the <br />reclamation plan. The existing financial warranty is more than adequate to complete this and <br />other reclamation tasks. The operator has followed the approved mining and reclamation plan <br />and has stayed within the boundaries of the 9.52 acre permit. area. There is no overburden <br />present at the Ross Pit. Available topsoil has been salvaged and stockpiled for use during <br />final reclamation. The operator has also secured water rights to mitigate for evaporative <br />loss of exposed groundwater. <br />5. Mr. Bauer explained that only limited activity has taken place at the pit during the past <br />4 years. For example, in 1998, the operator removed 200 tons of stockpiled pit run material. <br />The operator has done a good job of regrading the .existing pit slopes, where possible, to <br />final configurations. <br />6.
