III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a ptutial inspection of the Seneca II Mine conducted on July 26, 2006 by Mike Boulay <br />of the DMG. Dennis Jones of Seneca Coal Company (SCC) was present during the entire <br />inspection. ~Yeather conditions were hot and partly cloudy. It began raining lightly towazds the <br />end of the inspection. Ground conditions were mostly dry throughout the mine site. Cattle- <br />grazing was the only activity at the site during the inspection. Two ranchers were seen herding <br />cattle below Road E1. Cattle were also grazing in the East Wadge Pit azea and at Ponds 004 and <br />008. <br />Hydroloeic Balance <br />Sedimentation Ponds 002, 003, 004, and 008 were inspected. All of these ponds were full and <br />discharging clear water. No problems were noted at Ponds 002, 003, and 004. At Pond 008 the <br />dischazge pipe is partially uncovered on the out-slope of the embankment. It appears that cattle <br />grazing on the backside of the embankment may have uncovered the pipe. During the inspection <br />we stabilized the pipe with four metal posts and wire. SCC plans to re-bury the pipe. The <br />embankment should be reseeded once the repairs have been completed. Dennis Jones collected <br />water samples from the discharge at Ponds 004 and 008 for WET testing. <br />Roads <br />Roads were dry and generally in good condition throughout the mine site. Some blade work may <br />be required on the northern section of Road E 1. <br />Slides and Datnaee <br />The site of the slump/slide noted in the last inspection (June 21, 2006) was viewed from above <br />along Road E1. The seep appeazs larger and more prevalent. No additional movement in the <br />slide area was apparent. The slide does not appeaz to have the potential to impact the PECOCO <br />Pond or damage any access roads or other property. SCC does however, plan to repair the slide <br />damaged area. <br />
