<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the Hamilton Coal Mine was conducted by DMG staff from <br />the Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone 1970) <br />247-5469. No activities were observed. Operator has commenced final reclamation. <br />Mine identification signs and permit boundary markers were posted. Mine access <br />roads were well maintained. Road side drainage ditches and culverts appeared clear <br />and functional. <br />Sediment pond A, located at the far north end of the permit area was dry. Primary and <br />secondary spillways appeared clear and functional, no discharge noted. Pond <br />embankment and pond inslopes appeared stable, no evidence of seeping, slumping or <br />excessive erosion was observed. <br />Sediment pond B, located at the NE corner of the permit area, was holding water <br />approximately 6" deep. Primary and secondary spillway appeared clear and stable, no <br />discharge noted. Pond embankment appeared stable, no evidence of seeping, <br />slumping or excessive erosion observed. Isolated infestation of Russian knapweed was <br />observed on the embankment inslope, near the inlet to the primary and secondary <br />spillways. Evidence of recent vehicle activity was observed in the muddy pond bottom <br />and up steep portions of the pond inslopes. Evidence of erosion was observed at the <br />pond inlet on the SE corner of the pond. <br />
