III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection, conducted by Joe Dudash of the Colorado Division of <br />Minerals and Geology. Basil Bear represented the operator for part of the field <br />inspection. The weather vas clear and dry, although it had been wet in previous days. <br />Facilities <br />During the inspection, several haul trucks unloaded coal at the train loadout. No fugitive <br />dust was observed. No coal fines were seen on Highway 133, although the roadway was <br />somewhat darker in color at the entrance than further away from the loadout entrances. <br />Coal needs to be picked up along the railroad spur. <br />Hydrology <br />The collection ditch on the west side of the train loadout bench had sufficient capacity. <br />The railroad collection ditch was functional as well. The operator recently did <br />maintenance work on the diversion ditch that is upgradient of the train loadout pond. The <br />diversion ditches and culverts east of the train loadout entrances were functional. The <br />loadout pond was dry. The pond bin wall was stable. The operator had placed some dirt <br />into a hole that had developed in the soil that filled up the bin wall. <br />The ROM pile pond had a little water in it. The gated valve was closed. The collection <br />ditches and culverts leading into the pond were functional. The West Mine pond was dry. <br />The spillways were operational. <br />3ma11 Area Exem~ons <br />The railroad outslope at the train loadout was well vegetated, as were the ROM pile area <br />outslopes. The silt fences at the bottom of the north and south facing slopes at the West <br />Mine need replacing, although the slopes are well vegetated. The outslope of the vent <br />shaft bench and the topsoil stockpile above the West Mine are also well vegetated. <br />Weed Control <br />There is a small amount of bind weed on the west outslope of the train loadout.
