III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />The temporary culverted crossing of the west side refuse area collection ditch (to access the cover soil <br />pile for grading activity) needs to be pulled out to restore the full ditch cross-section. <br />The upper diversion along the upper edge of the cover material stockpile had been properly graded and <br />riprapped along the lower segment since the previous inspection. Seeding of the ditch will be necessary in <br />conjunction with the cover soil stockpile seeding. <br />TOpS011 <br />Some whitetop weed has encroached along the west end of the topsoil stockpile catchment ditch in the waste <br />disposal area vicinity and scattered across the north side of the same stockpile. Kill appears to have been poor <br />in these locations and spraying will be required next spring. It is important that whitetop be eliminated from the <br />soil stockpile area, <br />Reveoetation <br />Interim vegetation cover in the portal area and topsail stockpiles near the refuse area and adjacent to the lower <br />road segment is well established and effective in most areas. Initial establishment of grasses seeded in the <br />small repair areas of the portal backfill appears to be satisfactory. <br />The noxious weed whitetop is present in various locations in the vicinity of the waste disposal area, along the <br />roadsides from the waste area vicinity down to the highway, and on the lower road topsoil stockpile. Whitetop <br />patches in these various locations were sprayed since the last inspection, with apparently mixed results. Most of <br />these locations will need to be sprayed again next spring. Patches in various locations along the reclaimed drill <br />pad access road will also need to be sprayed next spring. <br />At the Loma Loadout, the western wheatgrass seeded in fall 2004 has made substantial growth this spring, and <br />there are numerous vigorous patches of the grass scattered across most of the site. Some of the grass plants <br />appear robust and have produced seed; other plants exhibit lower vigor. Continued dry conditions could be <br />deleterious. The subshrub prostrate kochia is also relatively abundant across the site, and there is a scattering <br />of greasewood, and widely scattered four-wing saltbush. Annual pioneer species are still prevalent, but <br />significantly less abundant than last year. In general, the prospects for establishment of a satisfactory stand at <br />the loadout look fairly promising. The small patch of Russian knapweed at the west end of the site was <br />apparently sprayed earlier this spring, but regrowth has been initiated and follow-up spraying appears <br />to be warranted. <br />5 <br />
