III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />General Comments <br />This was a complete quarterly inspection conducted by Dan Mathews of the DMG Grand Junction Field Office. <br />The reclaimed Loma Loadout was inspected at 7:30 am, mine site at 9:00 am. Weather was clear and very <br />warm; site conditions were dry. There was no activity at the mine or loadout site at the time of the inspection. <br />There was modest, cloudy flow in East Salt Creek; no flow in Munger Creek. Operator did not accompany me <br />during the inspection, but I did contact Walter Whitledge at the mine office at the conclusion of the inspection. <br />Availability of Records <br />Office records were reviewed on the afternoon of June 6. Required records were on file and up to date through <br />the 15~ quarter, 2006 with the exception of 15~ quarter 2006 coal mine waste pile P.E. certification. The <br />certification (signed 4/4/06, based on inspection of March 24, 2006), was provided by P.E. James E. Stover, on <br />6/6/06. A copy of the 1~~ quarter 2006 certification report needs to be placed on file at the mine office. <br />Sions and Markers <br />The Mine I.D. signs at both the mine and loadout need to be replaced or revised to reflect the permittee <br />name change to CAM Mining LLC. Marcia Whitledge at the mine office indicated the signs had been ordered <br />and were to be delivered and erected shortly. <br />Roads <br />Some of the road maintenance items noted in the previous site inspection had been conducted, but additional <br />maintenance is warranted in some locations. <br />Maintenance work is warranted along the canyon section of the mine bench access road, to clear rock <br />fall and sediment from the road ditch. <br />At the third CMP road culvert inlet, the berm adjacent to the inlet sump has been built up recently, and <br />needs to be seeded. <br />Installation of a series of water bars between the third and fourth CMP road culvert inlets is <br />recommended, to direct road drainage to the inside road ditch. <br />At the fifth road culvert, sediment material recently cleaned out of the inlet sump had been placed on top of the <br />road berm. The material needs to be pulled off the berm (to prevent sloughage over the outslope), <br />placed in an appropriate storage location, and seeded. The disturbed berm segment will need to be <br />seeded following removal of the material. Other berm locations along the road that were disturbed or <br />built up by recent maintenance activity should also be seeded. Seeding should be conducted during the <br />summer (mid July -mid August) seeding period. <br />Water bars installed last fall along the two-track road that provides access to the small topsoil stockpile adjacent <br />to the lower segment of the Munger Canyon haul road have been breached. These water bars need to be <br />restored, and enlarged, as appropriate, to ensure that flow is diverted off the two-track. Areas disturbed <br />by water bar repairs should be seeded following completion. <br />There is rock and woody debris lodged at the inlet of the 36" road culvert near the waste disposal area <br />pond embankment, slightly constricting the inlet opening. The debris should be removed. <br />3 <br />
