• <br />C, <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This partial inspection of the King Coal Mine was conducted by Wally Erickson from <br />the DMG Durango Office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (9701 247-5469. Operations were active during the time of this <br />inspection. Tom Bird was on site but not available to accompany the DMG inspector. <br />Signs & Markers -Mine identification sign and safety signs were posted at the mine <br />entrance. Permit boundary markers were observed. Public access is controlled by gate <br />and fence, gate was open. , <br />Roads -Mine entrance road and access roads were well maintained. Mine entrance <br />road drainage conveyance swale was intact.. <br />Hydrologic Balance -Upland diversion ditches and associated culverts appeared to be <br />stable and clear. Debris screens, located within the upland diversion ditches, were <br />clear of debris and intact. Sediment sump, located within the upland diversion ditch, <br />appeared full and needs cleaning. <br />Affected area drainage was conveyed to one of the two sediment ponds for treatment. <br />Culverts which convey affected area drainage appeared to be functional. <br />Large sediment pond was holding water approximately 2.75' depth. Primary and <br />secondary spillways appeared stable and clear of sediment and/or debris. Embankment <br />was well vegetated and stable. No discharge noted. <br />Small sediment pond was holding water approximately 2' depth. Primary and <br />secondary spillways appeared stable and clear of sediment and/or debris. Embankment <br />was well vegetated and stable. No discharge noted. <br />Coal Refuse Pile -Approximately 85% of the top of the refuse pile had been recently <br />graded to provide positive drainage to the sediment containment ditch. Finish grading <br />had not been completed for the remaining 15%. <br />
