III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />On June 16, 1997, William J. Carter from the Division of Minerals and Geology, performed a complete <br />inspection of the Hawk's Nest mine. During theinspection the weather conditions changed from clear arrJ <br />warm to partly cloudy and intermittent showers. <br />The inspection of the west end ofthe site around the sediment pond was completed on Tuesday mornirg <br />due to a coal train blocking access. <br />Hydrologic Balance: <br />• The springs on both sides of the east portal continue to discharge, and are causing some <br />slippage of the slopes above the road. <br />The seeps noted in the last inspection below the highway were dry during this inspection. <br />The sedimentation pond contains more water than last month, about two feet average depth was <br />noted. <br />Backfill and Gradine: <br />No settling was noted at any of the old portals. <br />Fish and Wildlife: <br />Some evidence of grazing of the vegetation by wildlife was noted. <br />Revegetation• <br />It appeazs that more vegetation is established this yeaz than last year. The alfalfa was especially heavy, <br />and along with yellow sweet clover has shown the greatest increase in vegetative cover. <br />Slides and Damaee: <br />There is continued movement of the soil above the road due to saturation from the springs. <br />Others: <br />Below is a listing of the weeds identified and their approximate locations. The entire site needs to be <br />walked to assure that the majority of the weeds are controlled. The inspector met with the Gunnison <br />Weed Control Coordinator and spraying was started on Tuesday, June 17, 1997. <br />Russian knapweed (Centaurea repens): <br />1.) South of the RR crossing adjacent to the silt fence at the western end of the site. <br />2.) Just east to the location listed above. <br />3.) Just east of the substation adjacent to the river. <br />4.) Below the RR right-of-away near the eastern end of the lower terrace of the western <br />section of the site. This area was sprayed last year and shows some regrowth. <br />5.) South of the guardrail along the south side of old SH 133, due north of the substation. <br />6.) Some isolated plants were noted south of the log home. <br />7.) At least two patches east of the west portal area. <br />8.) Below the east portal, south of the road, and south and east of the large rock is a <br />large clump. <br />9.) Another large infestation is located in the south eastern corner of the site adjacent to <br />the river. <br />
