~1 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented <br />the operator. <br />Facilities <br />For about a week, coal production at the Bowie No. 2 Mine had ceased due to equipment problems. <br />Once the stockpiled coal at Bowie No. 2 was exhausted, the coal at the Bowie No. l highway stockpile <br />was used for shipments. As a result, most of the coal at the highway stockpile is gone. Bowie No. 2 is <br />producing coal now. <br />Coal trucks were unloading at the train loadout but there were no problems observed with fugitive <br />dust. However, over time, the pavement of Highway 133 has been blackened by the coal truck traffic. <br />There were no coal spills along the railroad track spur. <br />The operator was trucking out belt equipment that had been stored at the crusher and screener level <br />bench at the east mine. <br />The gate at the west mine was open and additional fencing material had been placed on both sides of <br />the entrance road for a distance of about 70 feet. Straw was on the ground in this azea. It appeared that <br />the road azea had been used to pen up animals for a short time. <br />Roads <br />All of the roads were in good condition and were passable. No erosional problems were noted with any <br />of the roads. Road culverts and side ditches were functional. <br />Siens and Markers <br />Surface disturbance perimeter mazkers were present around the mine site. Mine ID signs were up at the <br />required locations and contained the correct information. <br />Hvdrolo¢v <br />There was a little water in the west mine pond, the train loadout pond and the highway stockpile pond. <br />However, all of the other ponds were dry. Pond embankments and bin walls appeared to be stable. <br />There were no erosional problems with pond inslopes. Pond spillways were functional. <br />
