III. Comments -Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any enforce- <br />ment actions taken during the inspection and the facts or evidence supporting <br />the enforcement action. <br />On December 1, 1993 a complete inspection was conducted at the Kerr Coal <br />Company Marr Strip Mine. Mr. George Patterson was present during the <br />inspection. At the time of the inspection the weather was cloudy artd cold. <br />Records were checked and found to be in order. <br />A(I ponds were frozen. There was about 8 inches of snow on the ground that is <br />a result of several stones in the past 2 weeks. The last inspection of this mine <br />was an aerial conducted November 9 and at that time there was onty a light <br />dusting of snow in the shaded areas. A storm on the 12th resulted in loosing a <br />working shift at the mine. <br />Construction of the pit dewatering ditch has been completed and this was being <br />actively used. Water was gravity flowing from the pit to the pond at a good rate. <br />Visual estimates of possibly 8 to 10 CFS were flowing. A flume that had been <br />installed earlier today was over toped. The flow was a thick opaque chocolate <br />color. Flow earlier today was reported by the operator to be 6 CFS. The flow is <br />regulated by the amount of fill pushed into the pit by the dozers. This displaces <br />the water in the pit. According to the operator the flow was fairly clear this <br />morning and the thick consistency of the flow noted at the time of this inspection <br />was probably bottom sediment that was pushed up from the bottom. <br />A pump was pumping from pond A to pond B. This effluent was fairly clear, <br />possibly passable under NPDES. The riser was covered a with yellow tarp as <br />approved in the recent minor revision. The water was a couple of feet below <br />the riser. <br />Backfilling and grading work was steadily progressing. The once prominent <br />overburden pile can hardly be seen from the mine office. The push from the pile <br />to the highwall is now uphill. <br />t?itches and culverts were mostly snow covered. <br />Ptt No.1 appeared to be almost to final grade. The grade of the bottom of the pit <br />is now above the level of the road and has a positive drainage. <br />
