III. COMMENTS -COMPLIANCE <br />Colowyo C-1981-019 <br />26 July 2005 <br />Pg 1/3 <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Colowyo Mine conducted by Jim Stark of <br />CDMG. Byron Walker of CDMG, Tay Tonoai and Kurfis Blunt of Colowyo <br />accompanied me. The portion of the inspection on 26 July 2005 dealt with a <br />meeting and site inspection of the proposed Lower Wilson mining area. The portion <br />of the inspection on 27 July 2005 was for the current permitted mine areas. The <br />records were checked on 28 July 2005. The weather was warm and sunny and the <br />ground was dry. <br />Availability of Records: All of the necessary records were available at the mine <br />office. See the records checklist at the end of this report for more details. <br />Roads: -The mine entry road is a paved road. The road was well maintained and <br />stable at the time of the inspection. <br />-The haul roads within the East and West pit areas were all well maintained and <br />stable. No rutting or erosional problems were noted on the roads at the time of the <br />inspection. The operator was watering the roads intermittenfly throughout the day. <br />-The roads within the Lower Wilson NOI area were well maintained and stable at the <br />time of the inspection. <br />-The Taylor Creek access road was stable and well maintained at the time of the <br />inspection. <br />Hydrologic Balance: This portion of the inspection was with Byron Walker and Kurtis <br />Blunt. <br />- The evaporating Pond 1 was dry and Pond 2 contained a small amount of water. <br />Both ponds were stable and in good condition at the time of the inspection. <br />-The sewage pond was full at the time of the inspection. The pond was stable. <br />-The wash bay pond was full but not discharging at the time of the inspection. The <br />pond embankment was stable at the time of the inspection. <br />-The work area pond contained water approximately two feet below the weep-hole <br />and four feet below the discharge pipe. The pond embankment was stable and <br />there were no erosional problems noted. The emergency spillway is a riprapped <br />channel. <br />- Culverts M and N along the haul/access road were inspected. Both were clear <br />and appeared to be in good condition. <br />-Sumps 1-5 along the Taylor Creek Access Road all contained water. All of the <br />sumps were stable and no sediment was leaving the sumps. <br />- The West Pit pond contained a small pool of water at the bottom and was not <br />discharging. The embankment was well vegetated and stable and no erosional <br />problems were noted. The presump contained water several feet below the spillway. <br />
