<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />On February 19 and 20, 1997, William J. Carter from the Division of Minerals and Geology <br />performed a partial inspection of Bear Coal Company's Beaz # 3 Mine. At the time of the <br />inspection the weather was partly cloudy, and had warmed enough to cause a considerable <br />amount of melting of the existing snow. <br />At the time of the inspection there was no activity at the site, and the gate was locked and <br />secured. Observations were made from several locations outside the permit boundary. <br />Hydrologic Balance: <br />• Due to the snow melt the yard and roads within the site contained standing water. This did <br />not appear to be excessive considering the weather conditions at the time of the <br />observation. <br />• The sedimentation pond contained water up to the primary spillway, but was not <br />discharging at this time. <br />then <br />On February 20 the inspector met with Basil Beaz and discussed the progress of the site <br />deactivation. Below is a listing of some of the topics covered: <br />1. The fan has been removed, except for the concrete. <br />2. A degasification pump has been removed. <br />3. Portal bench belt transfers have been removed except for the concrete. <br />4. Belt line overhead protection has been removed. <br />5. Removed assorted equipment from the site. <br />6. Will remove the staclting'tube belt during dry weather. <br />7. All portals are closed and include drainage systems. No water has been encountered at <br />these drain locations. <br />
