A site inspection of the Overlook Mine was made in response to a citizen complaint received from Ted & Terry Pratt on <br />June 16, 2007 (please see attached correspondence). Present on site was Mike Shear of Evans Holding Inc who was <br />crushing and processing pit run aggregate. A discussion was also held with representatives of Grandby Realty Holdings <br />LLC at their office immediately west of the Silver Creek/Solvista Ski Resort. Digital photographs were taken and are <br />attached to this report. <br />2. Review of the permit file indicates that a Regular 112 permit application for a total of 32.36 acres was approved on <br />February 23, 2007, with a financial warranty requirement of $57,000. Further, a Regular 112 Mining & Reclamation <br />permit (M-2006-075) was issued to Grandby Realty Holdings, LLC for the Overlook Mine on June 28, 2007. <br />3. On the date of inspection, there was no evidence that materials from the pit were being hauled offsite, ie off the <br />Grandby Realty Holdings LLC property. This inspector noted that processed aggregate materials were being hauled to the <br />Silver Creek development approximately 1 mile south of the Overlook Mine. <br />4. A letter from the Division to Grandby Realty Holdings LLC dated December 19, 2006 indicates that Silver Creek Resort <br />(currently Grandby Realty Holdings LLC) was granted an exemption from the requirement for a reclamation permit based <br />on information provided in their letter dated April 10, 1997 requesting a determination as to whether a reclamation permit <br />would be required for the proposed activities at the Silver Creek Resort. The basis for this request was that Silver Creek <br />Resort had an intent to use aggregate materials from the Overlook Mine, apparently owned by Silver Creek Resort, for <br />improvements on other portions of their development property. <br />4. Following the inspection, the Division received a verbal confirmation from Mr. & Mrs. Pratt that excavated and <br />processed aggregate materials from the Overlook Mine have in fact been moved off-site and used for other construction <br />projects. In response, the Division will keep this investigation open for the next 60 days.
