<br /> <br />INSPECTION REPORT - PAGE 2 <br />FILE N0. 78-279 <br />DATE: July 10, 1985 <br />OBSERVATIONS OF IMPORTANCE: <br />1. Mr. Baily will provide evidence indicating that the 0.49 acres, located <br />north and east of the road, on map (6-21-85) and the rock drainage <br />retention were disturbed by other parties, not related to the current <br />mining permit. Specify which parties, and when. Please note that if <br />the cut across (NE) the road was made by the County under the existing <br />permit, the current operator is responsible for reclamation under the <br />succession of operator commitments. <br />2. South boundary is now extended straight across to eliminate notch in <br />map (6-21-85). <br />3. Mine related disturbance extends east to the road, as now shown on <br />map (pencil). <br />4. Division has planimetered the following areas: <br />- modified boundary east and west of road = 9.08 acres; and <br />- modified boundary west of road = 8.59 acres. <br />5. The boundaries, as currently shown on the map ((5-21-85) amended in <br />field on 7/10/85), do constitute the mine permit boundaries. Any <br />activities occurring beyond those boundaries will be considered a <br />violation of the mining permit. <br />6. The Division encourages the operator to reclaim those areas where mining <br />is complete. <br />7. Please provide the documentation as requested above. Also, since the <br />acreage does exceed the approved 8.5 acres, a minor technical revision <br />to the permit will be required which acknowledges the agreed upon <br />boundaries (field 7/]0/85) and the new acreage numbers. The technical <br />revision will be a letter describing the new permit area and acreage as <br />outlined within this inspection report.
