Colorado 80660 OCI r~ 7 <br />j(~ ~ (7,s) 6as-2977 L / 1994 <br />~~\\RT FAX p19) 689-325a <br />Division of Minerals 6 Geology <br />October 23, 1994 <br />SENT BY FACSIMILE -COPY FOLLOWS BY MAIL, RETURN RECEIPT REQUESTED <br />Mr. Berhan Keffelew <br />Environmental Protection Specialist <br />Colorado Department of Natural Resources <br />Division of Mines and Geology <br />Office of Mined Land Reclamation <br />1313 Sherman Street, Room 215 <br />Denver, Colorado 80203 <br />Reference: Response To "Problem Noted" Contained In Inspection Report from <br />OMLR Dated October 11. 1994 -Temporary Soil Stockpile. <br />Dear Mr. Keffelew: <br />This letter responds, as has been requested by your Office, to the "Problem Noted" contained <br />in the Office of Mined Land Reclamation ("OMLR") inspection report dated October 11, 1994. <br />In that inspection report, which was received by the Cripple Creek & Victor Gold Mining <br />Company ("CC&V ") on October 18, 1994, notes that temporary soil stockpiles on the east side <br />of the "ready line" were incorrectly overridden with some fill material and, at the time of the <br />inspection, all dumping had been halted to prevent further overriding. The Inspection Report <br />requires removal of topsoil from the area by October 31, 1994. <br />As was observed by subsequent OMLR inspections during the week of October 17, 1994, all soil <br />that was overridden had been completely removed by October 18, 1994. The outside berm of <br />soil remains for the reasons explained to each OMLR inspector -there is inadequate room to <br />safely maneuver below the windrowed stockpile until the conveyor equipment located below it, <br />on the old Cresson haul road, is removed for erection. All soil that had been overridden was <br />removed and hauled to the Joe Dandy soil stockpile by October 18, 1994. Mr. Allen Sorenson <br />of your Office has twice observed the area after removal. Soil continues to be temporarily <br />windrowed for storage to the north of the problem area. <br />In the case of the remaining windrow of soil, CC&V has constructed a roadway where the <br />overridden soil was removed and this serves to catch any errant overburden from the fill and to <br />thus protect the remaining soil until it, too, can be removed. The newly-windrowed soil is being <br />protected by an upgradient windrow of overburden. <br />Examination of the area indicated that all soil materials were recovered and that no soil materials <br />were lost. Operations staff has been re-instructed that conservation and protection of suitable <br />
