III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. "1'he comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the operator <br />during the field inspection. <br />Signs and Markers <br />The mine id signs were up at the main entrance, east entrance and alone the east side road near the railroad <br />tracks. The information on the signs was in compliance. <br />Roads <br />The main paved haul road was in very good condition. The guard rail was itt place. The graveled east entrance <br />road was in good condition. 7'he gate was open.'1'he light use road along the railroad tracks was dry and <br />passable. <br />Facilities <br />No problems were observed at the office, shop, substation and loadine facilities. The material storage area was <br />in order. There were no coal loading activities taking place during the inspection, although quite a taw -oaded <br />coal rail cars were on site. No evidence of fugitive dust offsite or coal dust being tracked onto the highway was <br />observed. <br />Hvdrologv <br />There was a little standing water in the east sediment pond. The pond embankment was well vegetated and <br />appeared to be stable. Pond inslopes also were stable. The gated primary pipe was closed. The west dugout pond <br />was dry. The pond's spillway was functional. <br />Ditches on the site had sufficient capacity. The silt tance and straw bales were in place along the railroad track <br />small area exemption, Some of the straw bales had been replaced with new ones. <br />Topsoil Stockpiles <br />The east and west topsoil stockpiles had good vegetative cover, although the vegetation has browned.
