III. COMMENTS -COMPLIANCE Below are comments on the inspection. "1'he comments include discussion of observations made during the inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. This was a partial inspection conducted by Joe Dudash of the Colorado DRMS. No one represented the operator during the field inspection. Signs and Markers The mine id signs were up at the main entrance, east entrance and alone the east side road near the railroad tracks. The information on the signs was in compliance. Roads The main paved haul road was in very good condition. The guard rail was itt place. The graveled east entrance road was in good condition. 7'he gate was open.'1'he light use road along the railroad tracks was dry and passable. Facilities No problems were observed at the office, shop, substation and loadine facilities. The material storage area was in order. There were no coal loading activities taking place during the inspection, although quite a taw -oaded coal rail cars were on site. No evidence of fugitive dust offsite or coal dust being tracked onto the highway was observed. Hvdrologv There was a little standing water in the east sediment pond. The pond embankment was well vegetated and appeared to be stable. Pond inslopes also were stable. The gated primary pipe was closed. The west dugout pond was dry. The pond's spillway was functional. Ditches on the site had sufficient capacity. The silt tance and straw bales were in place along the railroad track small area exemption, Some of the straw bales had been replaced with new ones. Topsoil Stockpiles The east and west topsoil stockpiles had good vegetative cover, although the vegetation has browned. Topsoil signs were present.
