AND Seattle, WA 98106 ) CEASE AND DESIST ORDER TO: Colina Oro Molino, Inc. and all other persona engaged in owning or controlling the following operation: Gold Hill Hill located in Section 12, T1N, A72W, 6th P.M., in Boulder County, Colorado. PINDINOS OF PACT Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by C.R.S. 34-32-123, the Board hereby makes the following findings of fact: 1. Colina Oro Molino, Inc.is permitted to conduct a milling operation under the terms of Permit M-94-117 located in Section 12, Township 1 North, Range 72 Weet of the 6th P.H., in Boulder County, Colorado. 2. The Mined Land Reclamation Board conducted a Formal Public Hearing on December 14, 1995 to consider possible violation of the terms of permit M-94-117 and C.R.S. 34- 32-101 et sec. 3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on December 14, 1995, demonstrating that: Colina Oro Molino, Inc. had not completed repairs to the tailing pond liner by the Board Ordered date of November 20, 1995. NOTICE OF VIOLATION Bz:sed on these same findings of fact, and in accordance with C.R.S. 34-32-124(6) the Colorado Mined Land Reclamation Board hereby finds Colina Oro Molino, Inc. to be in violation of Permit M-94-117 and C.R.S. 34-32-116(7), subparagraphs (c), (g), and (i). CEASE AND DESIST ORDER Seised on these same Findings of Fact and Notice of Violation, and in accordance with C..R.S. 34-32-124(2), (6), and (7) the Colorado Mined Land Reclamation Board hereby orders Colina Oro Molino, Inc. to: 1.. Cease and Desist from conducting the following mining operations at the Gold Hill Mill - Permit No. M-94-117: Section 12, Township 1 North, Range 72 West of the 6th P.M., in Boulder County, Colorado. 2. Mail, within one (1) day after receipt of this Notice, to the Hined Land Reclamation Soard, written notice of your compliance with paragraph one (1) of this Cease and Deeiet order. 3. Complete the following corrective action: Complete and vacuum test all tailing pond liner repairs to the satisfaction of tt:e Division of Minerals and Geology staff. Provide independent certification from a person or firm experienced in quality assurance for flexible membrane liners that the repairs have been completed and tested in accordance with accepted industry practices and standards. This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator.
