III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. This former underground mine was reclaimed and reseeded in 1996 and early <br />1997. The weather was clear and ground conditions were muddy and partially snow <br />covered. This will be the eighth growing season for the majority of the reclaimed facility area. <br />Signs and Markers <br />Disturbed area markers are clearly visible in most locations marking the perimeter of the <br />reclaimed area. The entry sign remains legible and in compliance with Rule 4.02, posted just <br />north of the railroad grade along the access road into the site. <br />Revegetation <br />Vegetation is obviously dormant due to winter conditions. Litter cover is excellent and much <br />of the previous growing season biomass remains intact, providing good hydrologic cover. <br />Areas reclaimed to pastureland also display knee-high grasses and excellent ground cover. <br />Some repair of the fence in the pastureland areas may be necessary to prevent trespass <br />grazing. This growing season is the eighth growing season for the main facility area. The <br />operator may want to evaluate vegetation and approved sampling methodology in <br />anticipation of possible Phase III bond release sampling efforts in 2005. The condition of <br />reference areas and management practices of the reference areas and reclaimed areas <br />should also be considered. The Division recommends discussing sampling plans one year <br />prior to beginning vegetation sampling. The operator should also consider other remaining <br />tasks in year eight (8) that may delay bond release including well sealing and weed control. <br />The site appeared normal for the winter season and in excellent condition. <br />
