III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This partial inspection of the King Coal Mine was conducted by DMG staff from the Durango <br />Office, 701 Gamino del Rio, Room 125, Durango, CO 81301, phone (970) 247-5469. <br />Mine identification sign was posted at the mine entrance. Permit boundary markers were <br />posted. Entrance gate was open. Mine entrance road was well maintained. Drainage <br />conveyance swale, directing yard and road drainage to the small sediment pond, was intact and <br />functioning as designed. Yard area showed evidence of recent watering to control dust. <br />Large sediment pond was holding water, water depth was approximately 0.5'. Primary and <br />secondary spillways appeared intact, clear of debris and capable of functioning as designed, <br />no discharge noted. Pond embankment appeared stable. Overflow pipe to the small pond was <br />intact, no flow noted. <br />Small sediment pond was dry. Primary and secondary spillways appeared intact, clear of debris <br />and capable of functioning as designed, no discharge noted. Embankment appeared stable. <br />
