III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />DMG staff from the Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, <br />phone (970) 247-5469, conducted this partial inspection of the King Coal Mine. <br />Mine identification sign was posted at the mine entrance. Permit boundary markers were <br />posted. Entrance gate was open. Mine entrance road was well maintained. <br />All sediment containment ditches, culverts and ponds appeared well maintained and capable of <br />functioning as designed. Large sediment pond was holding water; water depth was <br />approximately 2 feet. Overflow pipe to the small pond was intact, no flow noted. Small sediment <br />pond was holding water; water depth was approximately 1 foot. Primary and secondary <br />spillways appeared intact, clear of debris and capable of functioning as designed, no discharge <br />noted from either pond. Pond embankments appeared stable, evidence of slumping, seeping or <br />excessive erosion was not observed. Drainage conveyance swale, directing yard and road <br />drainage to the small sediment pond, was intact and functioning as designed. <br />Upland diversion ditches appeared well maintained and capable of functioning as designed. <br />Sediment sump, near outlet of one of the upland diversion ditches, had been recently cleaned of <br />sediment. <br />
