IIL COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DBMS. No one represented the operator <br />during the inspection. <br />Roads <br />The road up Hubbard Creek canyon was dry and in good condition. The mine entrance light use road across the <br />creek was in very good condition. The light use road that leads to pond 5 was also in good condition. The <br />boulder that had fallen onto the road, which was reported in the previous inspection report, was moved to the <br />side. The entrance gate was closed and locked. <br />Signs and Markers <br />The mine ID sign was up on the entrance gate. Also on the gate was the "records location" sign. Surface <br />disturbance markers defined the disturbed area in general but more could be used to better define the area. <br />Hydrology <br />Pond 4 was completely dry while pond 5 had a little standing water in it. The embankments of the ponds were <br />stable and well vegetated, while the spillways were operational. The collection ditch leading to pond 5 was well <br />vegetated and had sufficient capacity. The black plastic pipe that channels water from the reclaimed area to the <br />pond 5 collection ditch was in place. The upland diversion ditch at the reclaimed coal stockpile area was well <br />vegetated. The road culvert leading to pond 4 was clear. The two Hubbard Creek culverts also were clear. <br />Reclamation <br />The backfilled and graded mine site appeared to be stable. No highwall remnant remained and there was no <br />evidence of slope instability or erosional gullying. There was a very slow trickle coming out of the north <br />underdrain while the other two underdrains were dry. There was one small seep near the base and a larger seep <br />in the middle of the first bench outslope. <br />There was a good vegetative cover on the reclaimed area although a patch of thistle was growing on the north <br />end of the first bench outslope. <br />c:/word/bluEribbon/insp0507 <br />
