III. COMMENTS -COMPLIANCE <br />Below are Comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Marr Strip Mine conducted on May 19, 2003 by Mike Boulay <br />of the DMG. George Patterson from Kerr Coal Company was at the site during a portion of the <br />inspection, but did not accompany DMG for the inspection. Weather conditions were sunny and <br />cool. The majority of the site was dry with very little snow cover remaining at the mine site. <br />Roads <br />The permanent light use road was accessible and mostly dry. The light use road had some minor <br />rutting and was still muddy in some spots. Overall, the road was in fairly good condition and <br />maintained. <br />Hydroloeic Balance <br />All of the site sedimentation ponds were viewed, and all of the ponds were retaining water. <br />Water in Ponds A through F appeared muddy or turbulent. Ponds D and C were full and <br />dischazging very small amounts of clear water. The remainder of the ponds were retaining water <br />but not discharging. Pond embankments and emergency spillways appeazed to be very well <br />maintained and stable. Only very minor erosion was noted at the inlet to Pond C. Some minor <br />rills have formed on the northwest side of this pond. The rills in the vicinity of the Pond C inlet <br />do not appear to be a significant erosional problem at this time. <br />Reve etation <br />Portions of the site that were inspected appeazed to be stable and in good condition. Overall, the <br />site is well vegetated and there were no significant areas of erosion or instability. <br />
