IV. ENFORCEMENT AC710NS <br />The following identifies enforcement actions taken during Phis inspection, the required abatement, and date of abatement for the <br />violation, previous violations still requiring abatement, and the termination of violations cited during previous inspections. <br />The availability of records on file at the Moffat County Court House were checked on February <br />17, 2004, at 16:00 hours. Tammy Raschke, custodian, and Sally Anderson, supervisor, were present. <br />Outdated TR-58 and RN-04 public notice materials on file we compiled into a separate packet. <br />Ms Raschke was to contact Colowyo for guidance on disposition. She did, as was confirmed with <br />Kurfis Blunt on this date. Colowyo will visit the Court House and withdraw those materials no <br />longer required. <br />Hydrologic Balance: The site was frozen over with one -three feet of snow, however a slight <br />thaw was being experienced. There had been, and was, some surface runoff. There were seeps <br />to low flow discharges from the Stoker Loadout, Gossard Rail Loop, and Gossard Loadout ponds. <br />These discharges were clear. There was a 0.58 cfs (0.28 gage reading) discharge from the <br />Streeter pond. Some of the inflow to the Streeter pond was overland runoff in the north fill riprap <br />ditch. Pond discharge was stained, but conveyed no settleable solids. There was snow but no <br />water exposed in the Gulch A or Prospect ponds. The Work Area pond water level was <br />estimated at one foot below the outlet. There were smaN amounts of water in the West Pit and <br />East Taylor ponds (levels well below the outlets(. The Section 16 pond was not accessible. Some <br />sediment had collected in some of the culverts and sediment traps below the haul road. These <br />items had been noted and recorded during a recently established monthly inspection program, <br />and work orders for maintenance were being processed. <br />Backfill and Gradina: Backfill (overburden from the West Pit) was being placed at the west side <br />of the east pit. A picture was taken of this placement. This picture, as well as others taken during <br />this inspection will be placed on file at the Division of Minerals and Geology (Division, and a <br />digital copy transmitted to the operator. A picture was taken of overburden being removed by <br />shovel in the West Pit, and being loaded into trucks. No grading was noted. <br />Explosives: The blast records of 2/1 /04, 2/12/04, and 2/17/04 were checked in detail. These <br />records, as well as the associated blasts, were in compliance with the Permit and Rules. The site <br />of the Durham Ranch seismograph and air-blast monitor was visited and a picture was taken. <br />The ATF blasting permit, S-CO-103-20-4E-12055, was on file. It expires May 1, 2004. Colowyo was <br />preparing a renewal application. <br />T~soi1: Topsoil storage piles were covered with snow; however, there was no appearance of <br />damage. Topsoil signs on the piles were noted. <br />General Mine Plan Compliance: Operations were in compliance. Extraction operations by <br />shovel and dragline were underway in the West Pit. Highwall mining was underway in the East <br />Pit, as was backfill operations by truck. There was no activity in the Section 16 Pit. <br />Fish and Wildlife: A few deer and elk were seen on undisturbed areas of the site. None were seen <br />on reclaimed areas. <br />Revegetation: Reclaimed areas were covered with snow; however, no damage to vegetated <br />areas was noted. <br />Air Resource Protection: Although access, light use, and pit roads were muddy, wind quickly <br />dried out some areas, and these areas became dusty. Dust was being controlled by water spray. <br />Excess Spoil and Devel~ment Waste: No hot spots, such as were noted in the previous <br />inspection in the West Pit Fill, were evident during this inspection. <br />
