III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. This site was idled following the shutdown and reclamation of the Lorencito <br />Canyon Mine (# C-96-084). The weather was seasonal and ground conditions were dry. <br />liydrologic Balance <br />Pond 7 held water to below the lowest row of holes on the primary riser. The pond 7 outlet <br />gate was found closed. The east containment at the West Mine was holding murky water. <br />Pond 8 at the RDA held water at about 6 inches below the top of the drop inlet riser. <br />Repairs at the emergency spillway/primary outflow channel intersection remain to be <br />completed. Pond 4 held only a small amount of water in the southeast corner. <br />Perimeter ditches flanking the river were found in good condition. Culverts around the site <br />were open although sediment was evident in a number of these culverts. The operator <br />should ensure that these culverts are kept open to pass design flows. <br />Backfillinq and Grading <br />Additional area of coal stockpile #2 has been pushed into windrows along the access road. <br />This material will be disposed of in the development waste pile to the west, Mr. Thompson <br />indicated this material might also be sold or hauled away for use in a cement plant. <br />Following final grading, the area will receive topsoil as per the approved permit. Topsoil is <br />available in two piles immediately adjacent to this area. <br />Support Facilities <br />The "grasshopper conveyors" located along the main access road have been removed from <br />the site. The operator should dispose of ancillary portions of these conveyors that resulted <br />from dismantling this equipment prior to requesting any cost estimate reduction or bond <br />credit for removal of the conveyors. The large hopper frame and truck dump bin have also <br />been removed from the site. Other facilities remain unchanged since the last inspection. <br />Topsoil <br />The large topsoil pile immediately east of the mine entrance was traversed on foot. The pile <br />is well vegetated with grasses and some shrubs and shows no sign or erosion, slumping, or <br />damage. The pile is properly marked as topsoil. <br />Revegetation <br />Former coal stockpile #4 and reclaimed pond 5 are nearing the end of the second growing <br />season. Grasses and fortis are becoming welt established among the normal compliment of <br />annual weeds. <br />
