(Page 2) <br />MINE ID .{ OR PROSPECTING ID ~ M-92-113 <br />INSPECTION DATE 01/30/96 INSPECTOR'S INITIALS RCO <br />OBSERVATIONS <br />This inspection was performed by the Division as part of its monitoring program of active 112 <br />permits. The operator was contacted about the inspection, and the representative named on <br />page one was present at the inspection. <br />The financial warranty is a corporate surety in the amount of $50,000. It ie sufficient to <br />reclaim the present disturbance. The operation has a stormwater management plan, No. COG- <br />500873. The permit sign was posted at the entrance near the county road. The permit corners <br />were marked with a steel post. The topsoil and overburden piles were located apart from the <br />rest of the operation. They were vegetated and appeared to be et able. There appeared to be <br />a sufficient amount to perform the reclamation. <br />The permit boundary is very irregular. The area is laid out to follow the gravel deposits <br />in three "finger ridges". The area's western portion is the largest and there is a large <br />pile of sand/fines there. Excavation has left several small, but vertical, highwalls. These <br />should be backfilled soon, since they are very close to the boundary and there is not a <br />sufficient buffer strip from which to push material down. <br />The eastern portion is only partly disturbed. Excavation is shallowest there, not apparently <br />deeper than six feet. Part of that area has been backfilled, though it has not been graded. <br />There is a portion of that eastern end, estimated at more than one acre, which has not been <br />disturbed. <br />The center portion of the permit also has been disturbed by excavation, though its depth <br />decreases as the mining progressed toward the south, ranging from 20 feet to two feet. There <br />is a large amount of sand/fines are stockpiled here too. Throughout the entire permit, there <br />are approximately 100,000 tons of sand/fines, which the operator does not use, but is of <br />great value to the county. The operator is currently in the process of transferring this <br />permit to Bent County. <br />Though the corners were marked, probably the combined factors of the complicated boundary, <br />rolling terrain and weeds along the edges of the disturbance, may have been responsible for <br />an area of offsite disturbance. The area between the eastern and central "fingers" of the <br />permit was stripped, shallowly excavated and partly backfilled. The size of the area is <br />about one acre. <br />This has been noted as a possible violation on page one, and the corrective action is <br />explained on the last page. There are several options the operator may wish to consider <br />pursuing to begin correcting this, in addition to whatever the Board may require. 1) The <br />operator may want to begin full reclamation of the offsite disturbance and not modify the <br />boundary. 2) The operator may want to file an amendment to enlarge the permit area, since <br />there is no acreage limitation to 112 permits. 3) The operator may want to modify the permit <br />boundary yet keep the permit area the same size, by "trading" undisturbed acres inside the <br />permit for disturbed acres outside the permit. (TO remind the operator: this was performed <br />at the S Bar C in 1995.} None of these options eliminate the fact that offsite disturbance <br />occurred, a possible violation which will be brought before the Board. But the options to <br />begin to correct the problem may be undertaken prior to the Board meeting.
