~S ~
i~i
Answer:
CO Division of Minerals & Geology
SHB ACRA Project E92-7075
Page 3
Dr. David Buckner, PhD. has written a response to this issue which is attached to this
letter.
Question A'S:
Your request for a letter from the U.S. Army Corps of Engineers on the remapping of
newly developed wetlands associated with leakage from the St. Vrain Supply Canal.
Answer:
Laurie Rink (project wetlands consultant) has remapped the wetlands and an updated
report is being sent to you under separate cover. The USACOE has been asked to
confirm the remapping.
The Corps of Engineers requires 404 permits only if wetlands are to be disturbed and the
only disturbance possible starts in year 10 of mining (on the Second Ridge). 404 permits
have a shelf life of 3 years so we could apply for any necessary permits no sooner than
3 years in advance of disturbance.
Please let me know if you have any questions.
Sincerely,
SH_B AG/R~A~Inc. 0
i~L-Gt.cX Y J~/i'~-
Paul Banks
Senior Project Manager
cc: John Lohr, Southdown
Parties to CMLRB hearing
Attachment
L^ A G R A
Esrth & Envimnmente/Group
