III. Comments/Compliance <br />This was a complete inspection conducted by Jim Burnell of CDMG on Thursday and Friday, <br />November 17 and 18, 2005. Weather was overcast, windy and snowing on Thursday, <br />beginning to clear on Friday. The mine site and loadout were both deserted and quiet. <br />There was 4-5 inches of fresh snow on the main mine site. The road was snow-covered and <br />drifted, but the ground was frozen under the snow and the road was easily passable. <br />Ponds A, B, and C were show covered. There was ice beneath the snow on A and B, while <br />C appeared to be empty of water and ice. The dams were stable. Pond D contained water <br />beneath the snow. The dam itself was stable. Pond E was snow-covered. The dam was <br />stable. Pond F appeared to have some ice beneath the snow. The dam was stable. Pond <br />G has been dry for months. The dam was stable there, also. <br />The sign at the entry does not reflect the current location of the records. This needs to be <br />up-dated. The gate was locked and secure. <br />The Pit 1 area was stable, with no erosion visible. <br />The facilities area was stable. <br />Signs on the topsoil piles for ponds F and G were not found and appear to have been <br />knocked down. Please erect the topsoil signs again on these remaining piles. <br />The loadout area was snow-covered. There were no signs of instability. The pond contained <br />some ice; the embankments were stable. The old shop building showed no problems. All <br />appeared to be in compliance. <br />The review of records showed that Kerr Coal Company has resumed sampling groundwater <br />wells 79-1, 2, 3, and 61, as was previously agreed, two years before bond release. <br />
