III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was an aerial inspection flown on October 30, 2001 by Harry Ranney of the <br />Colorado Division of Minerals and Geology. Kent Gorham of CDMG reviewed oblique <br />aerial photos in the office on November 6, 2001. The weather on this day was <br />conducive for good photography. This former underground mine will be used for <br />processing and loadout of coal produced from the Lorencito Canyon Mine (#C-96- <br />084). <br />Hydrologic Balance <br />All ponds and containments at the east mine were visible in the numerous <br />photographs. Pond 8 at the RDA held a significant amount of water but the level <br />appeared well below the discharge point. Ponds 6 and 7 near the prep plant were <br />dry. The three containments at the RDA conveyor were also noted as dry. Ponds 4 <br />and 5 were clearly visible and both held a small puddle of water in the bottom. <br />All pond embankments appeared in good condition. <br />Processing Waste <br />Two refuse piles exist at this site. The Refuse Disposal Area (RDA) is located <br />north of Highway 12. It was clearly visible in a number of the photographs. The <br />four reclaimed benches appeared in good condition with no sign of slumps, slides, <br />or damage. Downdrains appeared normal. The operational surface shows typical <br />erosion from extended exposure to rainfall. The 100-year diversion above the <br />refuse surface appeared functional. <br />Support Facilities <br />An excavator was noted working south of the industrial warehouse and northeast of <br />the substation in a previously disturbed area. A skid mounted substation was also <br />noted some 200 feet northeast of the excavation. <br />General Mine Plan Comaliance <br />Vehicles and equipment were noted near the prep plant and near the train <br />roundhouse. A shuttle train with 15 coal cars appeared to be unloading coal at <br />the clean coal conveyor leading from the prep plant to the silos (see photo). <br />3 <br />
