111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />1Ztis was a partial inspection conducted by Jce Dudash of the Colorado DMti. Bill Beaz represented the operator <br />during the inspection. There was no snow cover at any of the sites and the area was somewhat dry. <br />Facilities <br />The longwall was moved from the D-seam to the B-seam and tongwall mining in the B-seam began only about a <br />week ago. Also, there was a roof fall the night before the inspection so operations have been temporarily <br />suspended. Because of these, there was very little coal stockpiled at the coal stockpile bench along the state <br />highway. The Bowie No. 2 Mine is receiving the remaining wal refuse from the Bowie No. 1 Mine for washing <br />and shipping. No problems with fugitive dust were observed. <br />The contractor is fcnishing up construction work on the B-seam conveyor line. 'l'he cut slopes needed in the <br />construction of the B-seam conveyor are being regraded and compacted. The operator also repaired the small <br />slump in the cut behind the wash plant. The operator is also considering repair work on the slump in the road cut <br />just west of the D-seam portal bench. The water level in pond B was just above the primacy tube. <br />Gob Pile No. 2 <br />Gob pile no. 2 was in very good condition. One dozer was regrading the refuse on top of the second lift. The <br />refuse was moist but not wet. The top of the pile was completely graded and had positive drainage. There was <br />no ponding of water at all. The west side of the gob pile was covered in subsoil. A surveying team was at the <br />pile yesterday but the results are not ready yet, The operator has insta[ied perforated piping along the sides and <br />back of the gob pile, as designed. The underdrain was exposed ai the rear of the pile, also as designed. The <br />upland diversion ditch-had sufficient capacity. <br />The three ditches leading to Pond F had sufficient capacity. The riprap for two ditches was intact. Ponf F was <br />dry. The primary discharge pump was in place. The pond embankment was stable although devoid of <br />vegetation. Some of the slit fence between pond F and the road will need repair soon. Surface disturbance <br />markers were up azound the site, although more aze needed along the road. The gob pile haul road was in good <br />condition. The road surface was moist but not overly wet. The road berm was in place. However, the silt fence at <br />the base of the road will need repairs soon. Pond D next to the road had water just above the primary pipe. <br />Unit Train Loadout <br />A unit train was onsite for loading. Due to equipment problems, the loading was delayed but eventually was <br />completed. There. were no problems observed with fugitive dust. The culverts and ditches at the loadout were <br />functional: However, some of the silt fence at the base of the train track bench will need maintenance soon. <br />Also, one of the half culverts on the west end of the track bench needs to be pulled back upslope to catch the <br />water from the track culvert, Pond K was dry. The pond embanlanent was stable. The pond's collection ditch <br />was well vegetated and the spillways were functional. <br />The outslopes of'the train track bench had moderate to good vegetative cover and there were no signs of slope <br />failure. Since repair of a section of the upgradient Fire Mountain Canal, there have not been any springs <br />observed in the cut slopes on the east end of the track bench. The topsoil stockpile at the loadout had moderate ' <br />to good vegetative cover. The collecrion/diversion berm around the topsoil pile had sufficient capacity. Two <br />straw bales need to be replaced soon in the down gradient notch of that berm. Also, grazing animals need to be <br />fenced off of the topsoil stockpile. <br />c:lword/bowie2/insp0405 <br />
