One such matter is whether the Board should <br />set a date for completion of the corrective action in the Cease and Desist Order <br />accompanying Notice of Violation No. M-95-078. COM, Inc. understands that the <br />Division will recommend a completion date of February 16, 1996, contingent on COM, <br />[nc. waiving certain notice rights. <br />COM, Inc. believes it is unnecessary to set a completion date at the January 25 <br />hearing. COM, Inc. has engaged Colorado Lining Co., a reputable contractor satisfactory <br />to the Division, which is completing the corrective actions as quickly as weather allows. <br />Neither Colorado Lining Co. nor COM, Inc. can project a completion date with certainty, <br />but both are committed to completing the corrective actions to the satisfaction of the <br />Board and the Division as soon as possible. If weather does not permit completion before <br />the Board meeting on February 21-22, 1996, the Board then will have sufficient time to <br />set a completion date before the spring snow melt creates any potential containment risks. <br />JA+E1-I. /Rf96 <br />
