III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the New Horizon Mine conducted on September 29, 2005 by <br />Mike Boulay and Tom Gillis of the DMG. Ross Gubka of Western Fuels-Colorado (WFC) was <br />present during the entire inspection. Weather conditions were cloudy and cool. Ground <br />conditions at the mine site were damp due to rainfall prior to this inspection. Coal was being <br />loaded and hauled from the north end of the active pit at the time of the inspection. <br />Availability of Records <br />All required records were on site and available for review. Please see the attached records <br />checklist at the end of this inspection report. <br />Roads <br />Haul roads and access roads were in good condition throughout the site. <br />Hvdroloaic Balance <br />Sedimentation Ponds 007, 008, 009, 012, and 014 were viewed during this inspection. Pond 007 <br />was the only pond dischazging. The majority of dischazge from this outfall was the result of <br />water being pumped from the pit. Approximately 500 gpm were being pumped from the active <br />pit to Pond 007. Pond 008 was retaining a significant amount of water but at a level well below <br />the principal spillway. Ponds 009 and 012 were both retaining small amounts of water as a result <br />of the recent precipitation at the site. Pond 014 was dry. <br />E~losives <br />WFC is not required to have an ATFE Explosives Permit because they do not store, use or <br />transport explosives. A contractor conducts these blasting activities and explosives are delivered <br />from a neazby supplier when needed. WFC maintains detailed blasting records at the mine site. <br />Reve¢etation <br />Vegetation on reclaimed areas in the NH-2 mine azea is in good condition and well established. <br />Vegetation on the reclaimed NH-1 mine azea is less well established and appears somewhat <br />sparse. <br />
