III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made du n ng the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Minerals and Geology. This former underground site is entirely reclaimed. Ground <br />conditions were moist due to heavy rainfall on Tuesday evening. The weather on this <br />morning was cool and mild. <br />Availability of Records <br />The mine records are kept at the office of the County Clerk at the Las Animas County <br />courthouse in Trinidad. Please ensure that quarterly records are filed through the <br />previous quarter. The results of this records inspection are detailed on the attached <br />checklist. All required records were found in compliance. <br />Hydrologic Balance <br />The sediment pond held water up to the invert of the primary riser tube. A high water <br />mark of fine debris was noted some two feet above the outlet. The storm event Tuesday <br />evening was likely the cause of this temporary rise in the water level of the pond. A <br />slight trickle was discharging during the inspection. The trash rack was slightly covered <br />with debris and was cleared by the inspector. Cattails cover nearly all of the pond <br />surface area. <br />The 100-year diversion was walked along its entire length. The section immediately <br />behind the shop building should be cleaned of sediment. Erosion of undisturbed, upland <br />areas above the ditch at this location has resulted in minor capacity problems. <br />Process~n4 Waste <br />The slope of the refuse highwall was traversed on foot. No sign of slumps. slides. or <br />damage was noted. Contour furrows appeared generally in good condition and have about <br />of their capacity left. Some rills and gullies are developing and should be watched for <br />repair and maintenance as necessary. <br />Revegetation <br />Annual weeds dominate the interseeded portion of the refuse highwall slope. Some grass <br />plants were noted in the understory of annual weeds. The annual weeds do provide some <br />hydrologic cover. Noxious weeds are not a problem at this site. Soil moisture conditions <br />are excellent due to recent storm events. Overall, the site appeared in average condition <br />for the summer season. <br />3 <br />
