III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions Eaken during the rnspectron <br />and the facts or evidence supporting the enforcement action, <br />This was a complete inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation. Mining, and Safety (Diwsron). This former mountaintop removal operation is <br />now reclaimed and has achieved a Phase I bond release for most areas. Ground conditions <br />on this day were dry with some areas of standing water. Ron Thompson of Peak Project <br />Management was present during the inspection <br />Availab8dy of Records <br />The public copy of the mine records is kept at the office of Peak Project Management (PPM) <br />The contact, address, and phone number for PPM is Ron Thompson. Peak Profect <br />Management, 34115 County Road 20.8. Trinidad, CO 81082, 719-846-4975- Records were <br />found in compliance as detailed on page 2a of this report. <br />Hvdroio~ic Balance <br />Pond 9 was discharging <br />clear although the discharge <br />seemed somewhat erratic, <br />coming rn short pulses of <br />flow. The lower portion of <br />the primary riser was <br />submerged where the weep <br />hole exists. Possibly the <br />weep hole is partially <br />blocked The operator <br />should investigate and clear <br />any blockage so that the <br />pond can properly dewater. <br />Other ponds around the sde <br />held modest amounts of <br />water due to multiple <br />precipitation events since <br />the last inspection. Ponds <br />were not discharging and <br />embankments and spillways <br />appeared in good condition. <br />Some sediment cleanout <br />may be necessary on a <br />permanent ditch on the east <br />side of the reclaimed area <br />Sediment build-up at the <br />
