Mitigation considered was a variance to contemporaneous <br />redamation and an adjustment to the reclamation cost estimate. Upon review, the excess height <br />conforms to the worst-case scenario of reclamation. The worst case scenario is the basis for the cost <br />estimate. Therefore, no adjustment to the reclamation cost estimate is warranted. fie excess height is <br />considered in compliance with the permit until a bond release application, revision of the post-mining <br />topography, or the renewal of the Permit, whichever comes first. 2) Shaping of the slope above the East <br />Taylor Pond (scheduled for late July or August).
