III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection of the King Coal Mine for the month of August, 2001. The site is operating <br />at its normal rate and is stock piling lump coal for sale this fall. The mine has acquired additional contracts <br />and will soon be producing coal at a higher annual rate. <br />HYDROLOGIC BALANCE: Both ponds had water in them but were not discharging. All culverts and <br />ditches were inspected and found to be clear and able to properly function although there is one branch <br />at the invert of the culvert of the clean water diversion by the waste pile that needs to be removed. A <br />heavy downpour of rain occurred iwo days prior had minimal effect on the structures, however, some <br />water did get into the bathhouse. A diversion benn has been installed to prevent this from happening <br />again. <br />GENERAL MINE COMPLIANCE: The site is well maintained and has had a recent general cleanup. <br />EXCESS SPOILS AND DEVELOPMENT WASTE: The waste pile is stable and all water is diverted off <br />the top. The clean water diversion is down to bedrock and is stable (see photo). <br />
