PUBLIC NOTICE
The Colorado Division of Reclamation Mining and Safety proposes to reduce the
inspection frequency of the Coal Gulch Mine (Permit No. C-1984-067) from a minimum
of 12 inspections per year to one complete and three partial inspections per year.
The Coal Gulch Mine is a revoked/forfeited coal mine located in La Plata County,
approximately 4.5 miles west of the town of Durango, CO. The permit was held by
Peerless Resources Inc. The approximate legal description of the mine site is portions of
NW'/<NW'/a, N'h SW'/4NW '/< Section 22, N%aNWYo, and NE '/4 Section 21, and Section
16, all located in T35N, R10W, of the New Mexico Principal Meridian. The total permit
acreage encompasses 725 acres, with approximately 16.5 acres disturbed. The site has
been reclaimed since 1994 with some additional reclamation work since that time. None
of the original $140,000 of forfeited bond monies remains.
The Division is proposing to reduce the inspection frequency because the site has been
largely reclaimed and poses no imminent threats to public health and safety or significant
environmental harm to land, air, or water resources. Site conditions generally change
very little from month to month. The Division proposes one complete and three partial
inspections each year, conducted quarterly. This inspection frequency will be sufficient
for monitoring success of vegetation establishment, weed control, the function of a
sediment control/mine water treatment pond, and for identifying developing problems
which may require maintenance.
This decision is based on a complete inspection and written findings as required by Rule
5.02.2(8)(a) of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101,
et seq., C.R.S., and the regulations promulgated thereunder. Copies of the written
findings are on file for public inspection at the Colorado Division of Reclamation,
Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, Denver,
Colorado, 80203, telephone (303) 866-3567, and at the La Plata County Clerk and
Recorder's Office at 1060 E. Second Avenue, Durango, Colorado. Persons with an
interest that may be adversely affected by the proposed reduced inspection frequency
may submit written comments to the Colorado Division of Reclamation, Mining and
Safety, within thirty (30) days of this notice.
