III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of DMG. Tom Anderson represented <br />the operator during the inspection. With the operator's consent, this inspection report was issued from <br />the Denver office of DMG. <br />The ground was covered by a few inches of snow inmost azeas. The longwall was idle, in preparation <br />for a longwall move and to manage roof conditions. <br />Roads <br />The road surfaces of the East Yard, West Valley, and Elk Creek haul roads were in good condition. No <br />excessive erosion was found along these roads. The light-use road to pond D also was in good <br />condition, with no erosion problems evident. <br />Hydroloeic Balance <br />Ponds - Inslopes and embankments were in good condition at ponds A, B, and D. Water (ice) levels <br />appeazed to be a few feet below the principal dischazge level in all three ponds. Sediment from <br />cleaning out pond B is being temporarily stored in an impoundment in the East Yazd. <br />Ditches -The following ditches were in good condition and appeared to have design capacity: the <br />ditches along the East Yard, West Valley, and Elk Creek haul roads and the rock-lined ditches on both <br />sides of the West Valley Coal Refuse Pile. <br />Processine Waste <br />The face of the West Valley Coal Refuse Pile appeared in good shape with no erosional or slope <br />stability problems evident. Refuse was not being hauled during the inspection. <br />Support Facilities <br />No problems were found in the Elk Creek Facilities area. The fuel and oil storage area was properly <br />maintained. The portable powder magazines near pond D appeazed properly secured. <br />The conveyor corridor in the Elk Creek drainage appeazed well-maintained, with no material having <br />spilled outside the corridor. <br />Page 3 <br />
