<br />OBSERVATIONS <br />This inspection was conducted at the request of the operator to inspect a pre-law area <br />adjacent to the permitted placer. The operator had made a request to use permitted area mine <br />waste to fill in some low areas and add some cover material on the adjac nt pre-law area to <br />assist in reclaiming that area. The Division's initial response was that .this activity would <br />require an amendment to the permit since the actual affected area ould be expanded. <br />However, the operator was encouraged to request a Declaratory Order f~om the Mined Land <br />Reclamation Board to exempt this activity from needing an amendment if khey disagreed with <br />staff's interpretation. The operator has chosen to appear before the I~oard to pursue the <br />declaratory order but wanted to review the site with staff prior to tha~ meeting. <br />The area in question is just north of and adjacent to the existing perm t area. It covers <br />approximately 4-5 acres and consists of several piles of placer waste, w ich is essentially <br />unsorted, washed gravels. The operator is proposing to dispose of excess pverburden or waste <br />material into an low area within the pre-law area in order to raise theelevation so as to <br />blend in to the undisturbed hillside to the east. It does not appear thatemoving the amount <br />of material necessary to complete the pre-law reclamation would cause a aterial deficit on <br />the permitted area with respect to achieving appropriate post-mining sl pes. In addition, <br />his activity could compliment the regrading plan on the pre-law area by re ucing the material <br />deficit and allowing any regrading in this area to have longer and flatte slopes. Also, the <br />material that would be spoiled from the permitted area consists of a b tter texture for a <br />potential growth medium. The pre-law disturbance consists of a very coa se, cobbly material <br />and is nearly devoid of any vegetation. The landowner attempted to se d some of the more <br />level areas with very little success due to the cobbly nature of the ma erial. Basically, <br />the proposal makes good sense and would assist in reclaiming the pre-law area without being <br />detrimental to the permitted site.
