III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe ony enforcement actions taken during the inspection and the facts of evidence supporting the enforcement action. <br />Carry-over items of concern from previous inspections: None. <br />This aerial inspection report is prepared by Byron G. Walker from 15 aerial photographs (numbers <br />19-02-05-30-106 (106) through 19-02-05-30-118 (118), 19-02-05-30-120 (120), and 19-02-05-30-124 <br />(124) through 19-02-05-30-126 (126) and an oral debriefing of, Mr. Harry Ranney, Environmental <br />Protection Specialist of the Division. The pictures are on file at the Division and copies of the aerial <br />photographs have been provided to Colowyo Coal Company, L.P. by e-mail. The pictures were <br />taken on May 30, 20021 by, Mr. Ranney. Mr. Ranney stated (May 31, 2002) that he saw no <br />problems at the site. <br />No aspects of the mining and reclamation activities appear to be out of compliance with the <br />Rules or the Permit. <br />ROADS A portion of the haul road from the pits to the loadout is portrayed on Photograph 126. The <br />north terminus of this road is portrayed on Photograph 125. The road appears to be in good repair. <br />HYDROLOGIC BALANCE Surface water appears in Streeter Pond (pictures106 and 107), in Gulch A <br />Pond (picture 106), Section 16 Pond (Picture 117), and in the Taylor Pump Holding Pond (picture <br />126). The Streeter sediment control ditch is portrayed on picture 106, the East Side Ditch on picture <br />108, the Section 16 Pond Ditch on pictures 110 and 114, and the Section 16 West Taylor Ditch on <br />picture 117. The permanent reconstructed Streeter Gulch Ditch is portrayed on picture i06. The <br />permanent reconstructed Gulch A Ditch is portrayed on pictures 106 and 111. The permanent <br />reconstructed Section 11 Ditch is portrayed on picture 108. No deficiency appears at any of these <br />structures <br />BACKFILLING AND GRADING Backfilling by dragline back-casting is evident in the West Pit (pictures <br />106, 112, 113, 118, 120, and 124. Backfilling by dragline back-casting is evident in the East Pit <br />(pictures 108, 109, 110, 112, and 117. Backfilling by dragline back-casting is evident in the Section <br />16 pit (pictures109, 110, 114, 116, and 117. Shovel/truck operations appear (West to East Pit) in <br />pictures 113 and 120. No grading operations are identified in the photographs. These operations <br />appear to be in compliance with the Rules and the Permit. <br />SUPPORT FACILITIES The shops, field office, and storage areas appear in photographs 106, 111, 115, <br />116, and 118. The Gossard Loadout area appears in picture 125. All of these facilities appear to be <br />in compliance with the Rules and the Permit. <br />GENERAL MINE PLAN COMPLIANCE Active operations are observed in the East, West and Section <br />16 Pits.
