<br />Minesite Inspection Narrative <br />Page 2 of <br />As a result of this Federal inspection additional compliance problems were found at <br />the site and the following Notices of Violations were issued by the State of <br />Colorado: <br />C-93-124 for failure to maintain or install culverts C-5, C-35 and C-44 <br />C-93-125 for failure to store petroleum based material in an approved SPCC site <br />C-93-126 for failure to treat disturbed area drainage for area east of silos, topsoil <br />pile just west of RDA beltline and refuse coming off RDA beltline at the <br />river and highway <br />C-93-127 for failure to properly salvage topsoil from RDA stored at topsoil pile <br />west of RDA beltline and south of highway <br />C-93-128 for failure to maintain adequate freeboard on pond 6 <br />C-93-129 for failure to maintain diversion ditches D17, D24, D15 and D18 and <br />road ditches for portions of the west portal access road and the light <br />use road from the fan road to garage <br />Compliance problems covered under Notices of Violation C-93-126 and C-93-128 <br />were problems that were identified and cited in Notices of Violation C-93-059 <br />(freeboard pond 006) and C-93-058 (drainage off RDA) issued during the Federal <br />inspection of this mine in April of this year. Both violations had been terminated in <br />late July. <br />Mine identification signs with the required information, perimeter markers, topsoil <br />signs and buffer zone markers were in place. <br />The outlet of pond #007 was open and the structure was discharging while the <br />structure was being examined. Quality of water discharging appeared acceptable <br />but as there was concern about quality of water as the level in the pond lowered <br />the discharge was shut off by Mr. Lopez. <br />Pond #006 is a nondischarging structure but due to overfilling water was <br />overtopping the embankment on the south side of the structure and going into <br />pond #007. As a result the State of Colorado issued Notice of Violation C-93-128. <br />The five containment ponds, pond 004, pond 005 and the pond for the RDA <br />appeared to be in compliance. No sign of discharge was noted from any of these. <br />Diversions, culverts and ditches other than those covered under the Notices of <br />Violation appeared functional and in compliance although several needed <br />maintenance. <br />
