III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />This partial inspection of the Carbon Junction Coal Mine was conducted by DMG staff from the <br />DMG Durango Office, 701 Camino del Rio, Room 125, Durango, CO 81301, phone (970) 247- <br />5469. No individuals were contacted during the inspection. Reclamation equipment was <br />present but temporarily dormant. Evidence of recent reclamation activity was observed at the <br />south highwall and north highwall area. <br />Mine identification sign was posted at the mine entrance. Permit boundary markers were <br />posted. Topsoil stockpile signs were posted. <br />Backfill and grading of the south highwall to approximate 3H:1 V slope appeared near <br />completion. Topsoil, previously distributed on the rock fill area, was being salvaged to allow <br />additional grading to the rock fill area. Grading of coal refuse material and importation of <br />earthen cover materials had recently occurred at the north highwall area. <br />Sediment Pond 1, located at the far south end of the permit area, was dry, no discharge noted. <br />The pond embankment, inslopes and bottom were well vegetated and stable. Primary and <br />secondary spillways appeared to be clear of sediment and debris, and capable of functioning as <br />designed. Roadside drainage ditches and culverts, conveying affected area drainageto Pond 1, <br />were well maintained. <br />Sediment Pond 2, located along the west side of the permit area, was dry, no discharge noted. <br />The pond embankment, inslopes and bottom were well vegetated and stable. Primary and <br />secondary spillways appeared intact and capable of functioning as designed. Evidence of <br />erosion and sedimentation was observed at the pond inlet. Rock check dams were intact forthe <br />upper portions of the inlet ditch. Maintenance clean out of sediment between the check dams <br />appears necessary to ensure their continued function and to ensure adequate capacity for the <br />ditch. Evidence of erosion was observed in the steep slope portions of the ditch. Maintenance <br />of the rock check dams for the steep portions of the ditch appears necessary to ensure stability <br />of the ditch and pond inlet. Evidence of sediment escaping the sediment containment structure <br />was not observed. <br />
