III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Gillis of the Colorado Division ofMinerals and Geology. <br />With the operator's consent, this report was issued from the Durango office. <br />Roads <br />The operator has completed maintenance of the two small sediment traps located on either side of the <br />mine access road near the entrance gate. The traps were cleaned out and silt fencing replaced where <br />necessary. <br />Hydrologic Balance <br />The operator has completed maintenance work around the drainage culvert inlet located behind the <br />bathhouse. The culvert inlet has been repositioned and anchored in place with a concrete block headwall. <br />The ditch leading to the culvert inlet has been cleaned out and shaped to form a constant grade across the <br />area that had filled in from storm-generated sediments (coal fines). <br />Processing Waste <br />The waste pile showed no evidence of structural instability. The pile has a very slight crown neaz the <br />entrance azea and has been shaped to provide positive drainage off the pile surface. <br />
