(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~~fII.i1.Z- <br />INSPECTION DATE: n.-tabard, 9nns INSPECTOR=S INITIALS: A IW <br />OBSERVATIONS <br />This was a possible illegal site inspection conducted by Tony Waldron of DMG. The site is located approximately <br />22 miles southwest of Pritchett, Colorado near the intersection of Baca County Roads 3 & P in the south part of <br />Section 9 or the north part of section 16, Township 33 S, Range 50 West of the bah P.M. in Baca County, Colorado. <br />The mining area was situated along a sandstone outcrop in an otherwise gently sloping section of rangeland in <br />an area where more level terrain gives way to deeply dissected canyons as you go further south and west. The <br />outcrop is not very large and the operator was mining dimensional sandstone by removing overburden to <br />expose large layered slabs of sandstone. These exposed areas were then cut into approximately 2 foot by 3 <br />foot patterns 3 or 4 inches deep using a small rubber tire mounted circular saw. These slabs were then <br />dislodged using pry bars and a small skid steer with dual forks on the front, followed by stacking on pallets for <br />shipping. The entire working area encompassed approximafely 4 acres. The inspector was informed That <br />historic mining had occurred in this area and there was a short highwall approximately 100 feet long by 5-6 feet <br />high that did appear to be historic in nature. The present mining was occurring just south of this highwall, <br />however, overburden and waste sandstone material was scattered around the perimeter of the active site. <br />The foreman on site directed the inspector to the landowners, Ray and Stephanie Sikes, residence to obtain <br />information about any permitting that may have occurred prior to engaging in the mining operation. <br />Mrs. Sikes informed the inspector that they had been told (by their attorney, local authorities or someone) that <br />they did not need to get a permit to remove the sandstone if the disturbance remained below 5 acres. The <br />inspector informed Mrs. Sikes that they had likely been misinformed about permitting requirements and that our <br />office would be sending out a Reason to Believe letter and citing a possible violation for mining without a <br />permit.
