III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />of BB Detour where it ran south along BB Detour Road, across BB Road where it was <br />buried and then west to its terminus at 2700 Road. <br />Based on this inspection, it was determined that the entire length of the former above <br />ground pipeline has been successfully reclaimed. The pipe was removed from above <br />ground and reutilized by burying underground in its now permanent location. Some <br />sections of pipe that were not used remain at the site along the BB Detour but will be <br />removed from the mine site by Colorado Cooperative Ditch Company and used <br />elsewhere. The azea of the former pipe line from the point of beginning south to BB <br />Road is in dry land pasture. Photo No. 2 shows the location of where the former above <br />ground pipe line existed west of BB Detour. In this area west of BB Detour, there is <br />approximately 6.69 acres (not specifically associated with the pipe line) that has not been <br />final graded, topsoiled, or seeded. This location is in the vicinity of the pit and covered <br />under the performance bond for mining activities. The area west of BB Detour is <br />scheduled to be fully reclaimed during this summer. The location of the former above <br />ground pipe line from BB Road south and west to 2700 Road has been fully reclaimed <br />including grading to approximate original contour, topsoil redistribution, and seeding. <br />The reclaimed location is stable with no signs of erosion and has good vegetative cover <br />(see Photo No. 3). This area south of BB Road has been Phase I bond released. <br />2 <br />
