=,
III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the
inspection and the facts or evidence supporting the enforcement action.
This was a complete inspection of the Coal Gulch Mine for the month of August, 1998.
Hydrologic Balance: The pond had water in it but was not discharging. The outslope drainage
channel of the pond was covered with fill material by FireHawk Construction Co. Apparently they
feel since the pond is partially on their property, they have the right to alter the land as they see
fit.
Reclamation Success: The site is well vegetated and stable as far as erosion is concerned.
General Mine Compliance: Firehawk Construction Company continues to push the limit of their
property boundaries for their topsoil storage/ trash burning operation. To date, no outcries from
the public nor the other landowner has been recieved by either the Denver or Durango offices.
More construction material. junk, has been stored at the site. Rumors have been haerd that
several parties are interested in purchasing the mine site to use as a commercial site.
