A site inspection of the Church Pit was conducted in response to a complaint recently <br />received from Jim Lile of Jefferson County regarding a weed infestation of Diffuse Knapweed <br />at permitted mine sites north of Colorado State Highway 72 and west of the Rocky Flats <br />Technology Site. Present during the inspection were Tom Murray of Lakewood Brick & Tile Co., <br />Jim Lile of Jefferson County, Charles McKay of the Church Ranch Corporate Center, and Steve <br />O'Brian of Environment, Inc. <br />2. Rule 3.1.10(6) of the Construction Materials Rules & Regulations specifies that "Methods <br />of weed control shall be employed for all prohibited noxious weed species, and whenever <br />invasion of a reclaimed area by other weed species seriously threatens the continued <br />development of the desired vegetation. Weed control methods shall also be used whenever the <br />inhabitation of the reclaimed area by weeds threaten further spread of serious weed pests to <br />nearby sites." <br />3. The site inspection revealed that there is an infestation of diffuse knapweed at the <br />Church Pit, particularly over stockpile areas and around the periphery of excavations. <br />Approximately 40& of the 75.74 acre permit area is disturbed and susceptible to weed <br />infestation. Diffuse knapweed is considered to be a noxious weed within the State of <br />Colorado as defined by the Colorado Noxious Weed Control Act 35-5.5-101 through 119, <br />C.R.S. (1996 Supp.). Although weed control is not being applied at the Church Pit, the <br />operator is cooperating with the surface owner (Department of Energy), Jefferson County, and <br />adjacent landowners in developing an integrated weed control plan for diffuse knapweed for <br />the Colorado Highway 93 corridor between Golden and Boulder. <br />4. Review of the permit file for the Church Pit indicates that there is no weed control plan <br />for noxious weeds such as diffuse knapweed. The need for incorporating a weed control plan <br />into the mining and reclamation plan and implementing the plan as soon as practicable was <br />discussed with the operator. <br />5. The Division considers the infestation of diffuse knapweed at the Church Pit to be a <br />problem that will require corrective actions by the operator in order to bring the site into <br />compliance with Rule 3.1.10(6). In order to address this problem, the Division requests that <br />Lakewood Brick & Tile Company submit an application for a technical revision to the permit <br />which addresses control of diffuse knapweed, and begin implementing the weed control plan as <br />soon as practical. The application for a technical revision should be submitted to the <br />Division within 60 days.
