III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the
inspection and the facts or evidence supporting the enforcement action.
This was a complete inspection of the Coal Gulch Mine for the month of March, 1999.
Hydrologic Balance: The pond had water in it but was not discharging. The primary spillway is
covered with fill material and is no longer functional. The emergency spillway might work but
the old channel is totally cover with rocks and topsoil. Coal Gulch Creek is still open to flow, but
since the channel was reconstructed by FireHawk Construction, It is doubtful that it can handle a
25 year event. Water from Coal Gulch will not be diverted under the highway as in the past but
will continue down the side of the road.
Reclamation Success: The site is well vegetated and stable as far as erosion is concerned.
General Mine Compliance: Firehawk Construction Company continues to push the limit of their
property boundaries for their topsoil storage. More construction material and junk is being stored
at the site. FireHawk is well beyond the 1 .03 acres that belongs to them.
