• ~~
II. Compliance with Colorado Surface Coal Mining Reclamation Act
CRS 1973, as amended 39-33-101, et. s_e1c.,
and the
Rules and Regulations Issued Pursuant to the Act
This includes a Zisting of the particular provisions of the regulatory program which were
examined during the course of this inspection, and identifies enforcement actions taken
during the inspection for failure to comply with the Rules and Regulations, the Act and
the permit.
4,02 Sions and Markers
Perimeter markers were not checked during the course of this inspection. However,
the April 24, 1981 compliance deadline is still in effect and a thorough inspection of
the perimeter of the permit area will be made in June. This perimeter should be marked
so that a person can follow the permit boundary (as shown on Exhibit A, Mining Plan
Map) all the way around the surface facilities area.
4.03 Roads
All mine site roads have been graded recently. Ditches have been cleaned out
and re-established where necessary, and the coal stockpile area drainage has been
repaired.
4.05 Hydrologic Balance
1. The diversion ditch from the mine bench to sediment pond 1i2 was being repaired
at the time of this inspection. Several Large rocks had fallen into the channel, as
well as some fill material .from the face of the bench slope. This problem must be
corrected by June 12, 1981.
2. The outlet to sediment pond 1tI has been cleared of willow stems and a wire screen
has been placed over the opening in an effort to prevent the resident muskrat from
clogging up the opening.
3. The trash on the first switchback below the mine bench has been removed and hay
bales replaced. The culvert immediately below this switchback has been cleaned out and
proper drainage restored. This culvert appears to fill in quite frequently and should
be monitored closely.
4. The culvert at the coal stockpile area has not been repaired yet. The inlet end
of this culvert must be repaired or replaced by June 8, 1981. The ditch system for
this area has been repaired, however, and should function well.
5. Sediment pond N3 must be completed by June 29, 1981.
6. The area on the extreme North end of the mine bench has been regraded somewhat
in order to provide proper drainage from the bench area to the inlet end of the diversion
pipe, but it appears that water may still pool in this area. Proper drainage must be
restored by June 8, 1981.
