III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion. of observations made <br />during the inspection: Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DMG. No one represented the <br />operator during the inspection. <br />Facilities <br />There was a moderate amount of coal that was stockpiled on the bench. No railcars were being loaded, <br />although a dozen loaded cars were on site, and only one coal haul truck was unloaded at the time of the <br />inspection. There were no problems with fugitive dust offsite. <br />There were no problems observed at the material storage area, the office area and the substation. There <br />were no fuel leaks a[ the fuel facility. ' <br />H d~rology <br />The east pond was dry. The pond embankment was well vegetated and pond inslopes were stable: The <br />gated primary valve was closed. The west dugout pond was also dry. The silt fence section in the <br />discharge spillway was in place as was the riprap in the down channel. <br />Roads <br />The paved haul road was in very good condition. The graveled east side road also was in good <br />condition. The light use road along the railroad tracks was passable. <br />Suns and Markers <br />Permit marker signs were up around the mine site. However, the permit boundary could be better <br />defined with additional signs on the east side of the loadout area and along the west side railroad spur. <br />Also, some of the permit boundary markers could use replacement along the north side of the permit <br />area. <br />Mine ID signs were irp at the entrance and on the east side of the loadout. The information was correct. <br />Topsoil Stockn.~es <br />The east topsoil stockpile had good vegetative cover, although a few spots could benefit from <br />reseeding. The west side topsoil stockpile had good vegetative cover on the north facing side, while the <br />south facing side had poor vegetative cover. Resseding here may also be needed.
