III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion. of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. . <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Jim Kiger <br />represented the operator. The area received about 2.5 feet of snow a couple of weeks ago. Much of the <br />loadout site was covered with about 1 foot of snow. <br />Facilities <br />The field inspection took place after work at the loadout was over for the day. There were no coal haul <br />trucks unloading or rail cars being loaded during the inspection. Loaded and unloaded rail cars were <br />onsite. The coal stockpile was moderately large in volume, especially with finely sized coal material. <br />However, there was no sign of fugitive dust offsite. <br />There were no fuel leaks at the fuel facility. The containment bean was functional. The material <br />storage area and the substation were covered in snow. No problems were observed at any facilities. <br />Hydrology <br />All of the sediment control structures were covered in snow. The snowmelt level in the east pond was <br />about 3 feet below the gated primary. The gated valve was closed. The west pond was snow covered. <br />Roads <br />The main paved haul road was clear of snow and dry. The east road was graded. The east gate was <br />open. The road along the railroad tracks was passable. <br />Topsoil <br />The east topsoil stockpile was covered in snow, as was the north side of the west stockpile. There was <br />no evidence of gullying. Topsoil stockpile signs were up. <br />Signs and Markers <br />Mine ID signs were up and contained the correct information. Surface disturbance markers were <br />located azound the mine site. <br />Records <br />The records were in compliance, as noted on the following records checklist. <br />c:/word/terror/insp0104 <br /> <br />
